RENTAL CONDITIONS
GENERAL CONDITIONS OF CONTRACT: hereinafter Contract, concluded between Fest Auto Rent a Car SL with NIF number B56593312 and registered office at Calle James Ensor N 2B, urb. El Chaparral, 03184, Torrevieja, Spain hereinafter Fest Auto Rent a Car (also called lessor) and the Lessee, whose identification data is included on the front of the Contract, (hereinafter the lessee).
1. PURPOSE OF THE CONTRACT, DOCUMENTATION, OBLIGATIONS AND PROHIBITIONS
The purpose of this contract is the use of the driverless vehicle for the expressly contracted service. The services are governed exclusively by these particular conditions and general conditions set out below and signed by both contracting parties.
Fest Auto Rent a Car delivers to the lessee for rent without a driver the vehicle described in the corresponding contract signed by the lessee, in perfect operating conditions, with all its documents, tires, tools and accessories, as well as in good general condition on the outside and in. cleaning and the client declares to receive the reviewed vehicle having previously verified that its operation and general condition is good and that he accepts and is bound by the particular conditions, committing to return it running or towed to the company offices on the day of expiration of the present contract.
It is the responsibility of the tenant:
- Return the vehicle on the expiration day and time set in the contract, otherwise and after 24 hours from the date it should be delivered, the vehicle will be reported to the competent Authorities as a crime of misappropriation for criminal purposes. and civil.
- Return the contracted vehicle in the same conditions as it was delivered, with all its components, tools, documentation, keys, etc. and without carrying out in any case fraudulent manipulation of any element, external or internal thereof.
- Driving under the negative influence derived from physical conditions motivated by the consumption of alcohol, drugs or narcotic substances, as well as fatigue or debilitating illness and/or medications that affect attention.
- Responsible for all liabilities, whether civil, criminal or of any kind arising from:
* Use of the leased vehicle during the term of the lease.
* Abandonment or misuse of the vehicle.
* Not to transport more people in the rented vehicle than permitted, as well as any type of merchandise or documentation, utensils, materials, objects or anything that the laws prohibit to transport, use, etc. and with strict compliance with the legal provisions regarding weight, height, quantity, volume and nature of the cargo, being at your own expense and risk any responsibilities arising from the violation of this section, whether civil, criminal, governmental or of any kind.
* Respect at all times and places the rules of the Traffic Code in force, as well as any legal provisions on traffic, transport and Road Safety. It is the responsibility of the lessee to pay in full any fines or sanctions of any kind imposed on the lessor for acts committed during the term of the lease. In the event of removal and/or immobilization of the vehicle, whether by tow truck service, court order or police order, the lessee must bear all the expenses incurred in the recovery of the vehicle, as well as the days of its stoppage.
It is strictly prohibited:
- Using the rented vehicle as a means or instrument for the commission of crimes classified in criminal laws, assisting criminals or transporting or sheltering objects originating from crimes.
- Assign, rent, sublease the vehicle by leasing it to a third person.
- Use the rented vehicle in order to teach it how to drive.
- Using another type of fuel other than the one permitted in the rented vehicle.
- Allow the vehicle to be driven by people who are not expressly authorized in the contract.
- Driving the vehicle outside the national territory of Spain, unless expressly authorized by the lessor in writing after prior communication from the lessee.
- Use the vehicle to push or tow other vehicles, or participate in races, contests or competitions/challenges of any nature.
- Driving on unpaved roads or roads not suitable for the circulation of passenger class vehicles.
- Using the vehicle for commercial/work purposes and/or transportation of goods/courier service, etc.
- Smoking is prohibited inside our vehicles.
The client must be in possession of the original and valid driving license. The following documents are required to pick up the vehicle: DNI/Passport, Driving License. If you do not have an EU driving license, you will need to bring an international driving license along with your original license to rent the car. If the contract holder and all drivers included in the contract do not provide the documentation described above, delivery of the vehicle will not be possible.
2. RATES AND FRANCHISE
At Fest Auto Rent a Car we have this rate, this rate includes:
- Comprehensive insurance without deductible or deposit (or deposit).
- Full – full fuel policy.
- 24/7 roadside assistance.
- Theft insurance.
- Unlimited mileage.
- Free Cancelation.
The office opening hours are 24 hours a day.
3. VEHICLE RETURN
The vehicle will be returned to the place, date and time stipulated in the contract and in the same condition in which it was delivered by the lessor, with all its documents, keys, tools and accessories. Any alteration in the agreed return conditions may result in additional charges for the lessee.
In the event of early termination of the contract by decision of the tenant, the latter will not have the right to a refund of the days not enjoyed in the rental.
There is a courtesy margin of 30 minutes of delay in returning the vehicle with respect to the agreed time, so if it is returned outside of that margin the lessee will pay an extra amount of €20 in addition to the full payment of the fare. daily. The final amount for this reason will be subject to the time of return of the vehicle.
If the lessee wants to extend the rental of his vehicle over time, he must notify the lessor sufficiently in advance, sign a new contract for the extended days and pay a new amount immediately to cover the new one. service, the lessor not guaranteeing that said extension can be carried out.
4. RENTAL CHARGES AND PAYMENT METHODS
4.1 Rental charges
The lessee agrees that Fest Auto Rent a Car may make charges for the following items after the end of the vehicle rental, through electronic payment systems or in any other way, without their express authorization:
1. Charge for an extra cleaning service as a result of the manifestly inadequate condition of the vehicle at the time of its return. Additionally, stains on the upholstery, including those caused by saltpeter and excessive remains of sand, animal hair, the smell of tobacco or other substances, will be considered to be in poor condition of the vehicle, with a maximum surcharge of €50 being applied.
2. Charges caused by the loss of documents and vehicle keys, applying a maximum surcharge of €250.
3. The tolls, fines, penalties and legal expenses caused by traffic violations or laws, regulations or ordinances, (including charges for congestion or limitation of road traffic where they exist,) incurred by the client during the duration of this Contract.
4. The repair costs, in their entirety, of the damage caused to the vehicle in the event of an accident, when any of the following circumstances occur:
- That the vehicle was not used in accordance with the established conditions.
- That the accident report - either in the form of a 'Friendly Accident Declaration' -DAA- or an 'Accident Report' had not been completed and sent to Fest Auto Rent a Car within the established period, or that it did not comply with the reality of the events produced.
- That the vehicle was driven by a person not expressly authorized in the contract.
4.2 Way to pay
Payment by card for the rental of the vehicle and the different additional concepts will be made in the currency chosen by the lessee, accepting multi-currency operations, subject to the conditions of the Banking Entity that manages the payment or collection, according to the choice of the customer.
Payment for the vehicle rental and the different additional concepts will be made in the Euro currency.
5. INSURANCE AND COVERAGE
The settlement of the contracts includes the payment of mandatory automobile insurance and mandatory civil liability coverage. These coverages are guaranteed and assumed by the insurer with which the lessor has arranged the corresponding insurance policy, leaving the lessee and authorized drivers, by signing this contract, adhered as insured to said policy.
6. ACCIDENTS
The lessee undertakes to inform Fest Auto Rent a Car of any accident within a maximum period of twelve hours and to transmit any notifications that refer to said accident, providing the corresponding accident report or complete data of the opposing party and possible witnesses.
The lessee must not prejudge nor will he recognize responsibility for the fact, he will collect all possible data and notify the authorities if there is guilt on the part of the opposite party.
7. FUEL
It is the lessee's responsibility to refuel the vehicle with the appropriate type of fuel and additive, the amount of which will always be at their expense. Any expense or repair derived from the use of inappropriate fuel will be the responsibility of the lessee. The vehicle must be returned with at least the amount of fuel in the tank that appears in the box in the “expected return” section. If this is not the case, the lessee must pay the missing amount of fuel at the price in force at that time. The lessor markets the “Full – Full” fuel policy.
8. EXTRA CHARGES
The settlement or final total amount of the rental is subject to the return of the vehicle in the same conditions in which it was delivered and on the scheduled date, time and place, for which the lessee must pay the lessor, once returned the vehicle, any extra charge incurred attributable to said lessee based on these general conditions.
9. THEFT, DAMAGE AND LOSS OF PERSONAL OBJECTS
Under no circumstances will Fest Auto Rent a Car be responsible for objects stolen, damaged, forgotten or lost inside the vehicle.
10. JURISDICTION AND APPLICABLE LAW
This contract will be governed by Spanish laws and, in the event that the lessee deserves to be considered a consumer or user, any discrepancy will be submitted to the jurisdiction corresponding to the place of fulfillment of the obligation, said consideration being that of the place where the obligation was fulfilled. The rental began, and all of this in accordance with what is expressly established in current regulations regarding consumers and users.
However, the above, and in accordance with what is expressly established in article 38 of Law 16/1987, of July 30, on the Regulation of Land Transport, Fest Auto Rent a Car, expressly expresses its will against the resolution of any controversy arising as a result of the contracting of vehicle leasing services is resolved through the Transportation Arbitration Board.
11. ADDITIONAL PROVISION
It is the landlord's responsibility to read this contract carefully; Any doubt or disagreement must be stated before accepting and/or signing the contract.
In the event of non-compliance with any of these clauses, the lessee assumes all responsibility for any damages that such non-compliance may cause to both the lessor and third parties.
